Terms and Conditions for Wellness and Workouts’ "Giveaway."

NO PURCHASE NECESSARY. A PURCHASE OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING. 


Your participation in Wellness and Workouts’ Giveaway ("Giveaway" or "Promotion") shall be deemed to be your complete acceptance of the Terms and Conditions herein. The following are the Terms and Conditions of the Giveaway, which is sponsored by Wellness and Workouts, the operator of the website www.Wellness-and-Workouts.com ("Wellness and Workouts" or "Sponsor").

1. Eligibility: Only persons age 18 and older are eligible to enter the Giveaway. If required, you may be asked at any stage, to provide Wellness and Workouts (or a third party) with proof of age and/or identity. Immediate family members of Wellness and Workouts are not eligible.

Entrants must be residents of the United States. Prizes will only be shipped to addresses within the US.

2. Timing: The Giveaway shall take place on the date specified on the Giveaway page at: https://www.wellness-and-workouts.com/sweepstakes-and-giveaways.html

3. Sponsors: If a third party sponsor is involved, sponsor's name, website, and other information will be posted on the Giveaway page.

4. Entries: Each entrant shall be entitled to make only one (1) entry per available option in the Giveaway. Using multiple email addresses for additional entries is prohibited. In the event that Wellness and Workouts deems an entrant to have made multiple applications to enter or to have acted in bad faith with respect to the Promotion, the entrant shall be excluded from the Giveaway and consequently ineligible to win the Promotional Prize, as defined below.

5. Prizes: Promotional Prizes (the "Prize") for winning the Giveaway shall be posted on the Giveaway page. Prizes will be sent to the Giveaway winner after the winner has provided Wellness and Workouts with a valid email address (for digital prizes), a valid US mailing address (for non-digital prizes), and/or proof of identity (if required).

For all Prizes: Prize is neither transferable nor exchangeable and cannot be exchanged for money or money's worth. No substitution will be made except as provided herein at the Sponsor's sole discretion. Sponsor reserves the right to substitute a prize for one of equal or greater value if the designated prize should become unavailable for any reason.

6. Winning Notification: Wellness and Workouts shall notify the winner of the winning via email and/or third party giveaway entry platform (including, but not limited to, Rafflecopter.com) within seven (7) days of the Giveaway.

The winner is required to provide Wellness and Workouts with a legitimate email address and/or physical address within seven (7) days of the sending of the winning notification.

Your participation in the Giveaway is considered your agreement that Wellness and Workouts may contact you.

7. Awarding of Prize: After Wellness and Workouts’ receipt of the required details from the winner in order to send Prize to the winning entrant, the winner shall receive the Promotional Prize: (1) within fourteen (14) days for digital prizes; (2) within sixty (60) days for non-digital prizes.

Notwithstanding the above, in the event that, for any reason whatsoever, the Prize winner fails to respond within seven (7) days to the notification of his/her winning, such winning entrant shall be deemed to have forfeited his/her claim to the prize and Wellness and Workouts shall not have any obligation whatsoever to compensate the winning entrant in any way.

Wellness and Workouts’ decision is final with respect to all matters relating to awarding of the Prize and shall not be subject to review or appeal by any entrant or by any third party.

8. Release: By entering the Giveaway each entrant agrees to release, discharge and hold harmless Wellness and Workouts, its legal representatives, affiliates, subsidiaries, agencies and their respective officers, directors, employees and agents from any damages whatsoever suffered or sustained in connection the Giveaway or the acceptance of the Prize.

9. Publicity: Participation in the Giveaway constitutes the winner's consent for Wellness and Workouts or a third party Sponsor to disclose winner's name, likeness, photograph, opinions, entries, and/or hometown and state, for promotional purposes in any media, worldwide, without further payment or consideration.

10. Taxes: The winning entrant shall be solely responsible for any taxes levied in relation to the delivery or receipt of the Prize.

11. Limitations of Liability: Wellness and Workouts is not responsible for (1) any incorrect or inaccurate information by entrants, technical or human error which may occur in the administration of the Giveaway or the processing of entries (2) an entrant's entry that has been erroneously deleted, lost, or otherwise destroyed or corrupted.

Sponsor reserves the right to only award the stated Prize by a random drawing among all legitimate, un-awarded, eligible entries.

12. General Conditions: By entering the Giveaway each entrant unreservedly agrees to these terms and conditions which govern the Giveaway and the awarding of the Prize.

Wellness and Workouts reserves the right, at any time, to cancel, suspend and/or modify the Giveaway if, in its sole judgment, the Giveaway is not capable of being conducted as specified, if any fraud, technical failures or any other factor beyond Sponsor's reasonable control impairs the integrity or proper functioning of the Giveaway, as determined by Sponsor in its sole discretion.

Wellness and Workouts reserves the right to alter these Terms and Conditions at any time and in its sole discretion.

13. Laws: These terms and conditions and any matters relating hereto shall be governed by, and construed in accordance with the laws of Arizona and shall be subject to the exclusive jurisdiction of the courts of Arizona.
